At the regular School Board meeting on September 11, 2006 in the New Business section, action was taken regarding an agenda item for Approval of Advertising a Notice of a Proposed Rule Policy 4.5, Instructional Materials, and Setting a Public Hearing on the Proposed Rule at the Board Meeting Scheduled for September 25, 2006.

It was discovered that the date was in error, and the Board Attorney advised not to advertise the public hearing as it would be in violation of Administrative Procedure Act (APA) guidelines.  Therefore, it is necessary to rescind the action taken regarding this item and, at the same time, approve advertising a notice and setting the hearing for the Board meeting scheduled for October 23, 2006.

The Superintendent recommends rescinding the action taken on September 11, 2006 setting a Public Hearing for September 25, 2006 and advertising the notice of rule adoption for that day; and to approve setting the Public Hearing on proposed rule policy 4.5, Instructional Materials, for October 23, 2006, and authorizing the advertising the Public Hearing for that date.

Motion and approval to rescind the action taken on September 11, 2006 setting a Public Hearing for September 25, 2006 and advertising the notice of rule adoption for that day; and approval to set the Public Hearing on proposed rule policy 4.5, Instructional Materials, for October 23, 2006, and to authorize the advertising the Public Hearing for that date.

The fiscal impact will be the cost of the legal advertisement, not to exceed $200.00.
